Data Retention Policy


Purpose

This Data Retention Policy outlines how TrustlyPay Financial Technology Private Limited (“TrustlyPay”, “we”, “our”, “us”) retains and disposes of personal, financial, and transactional data in compliance with applicable laws, including RBI, NPCI, UIDAI, IRDAI, GST, and Income Tax regulations.

Scope

This policy applies to all data collected, processed, and stored by TrustlyPay in connection with its services, including AEPS, mATM, UPI, payment gateway, taxation, and insurance distribution.

Categories of Data and Retention Periods

  • Personal Identification Data (Name, Address, PAN, Aadhaar, GSTIN) – Retained for a minimum of 8 years after the termination of the relationship, as required under RBI and UIDAI guidelines.
  • Transaction Data (AEPS, mATM, UPI, Payment Gateway) – Retained for a minimum of 8 years from the date of transaction, in accordance with RBI and NPCI regulations.
  • Biometric Data (AEPS Authentication) – Not stored by TrustlyPay. Processed in real-time and transmitted securely to UIDAI-authorized systems.
  • Taxation Records – GST and ITR-related data retained for a minimum of 8 years from the date of filing, in compliance with the Income Tax Act.
  • Insurance Records – Policyholder data retained for the term of the policy and for at least 8 years thereafter, in line with IRDAI norms.
  • Customer Support & Dispute Records – Retained for a minimum of 2 years from resolution or as required by law.

Data Storage & Security

  • All retained data is stored in secure, encrypted systems with restricted access.
  • Physical documents are stored in secure facilities with access logs.

Data Disposal

  • At the end of the retention period, data will be securely deleted, anonymized, or destroyed to prevent unauthorized access.
  • Digital data will be wiped using certified deletion tools.
  • Physical records will be shredded or incinerated.

Exceptions

If data is required for ongoing investigations, legal claims, or audits, retention may be extended beyond the specified period.

Policy Review

This policy will be reviewed annually and updated as required by changes in laws or business operations.
