Terms & Conditions
These Terms & Conditions (“Terms”) govern your access to and use of the services provided by TrustlyPay Financial Technology Private Limited (“TrustlyPay”, “we”, “our”, “us”) through our website, mobile applications, APIs, devices, and partner networks. By using our services, you agree to be bound by these Terms. If you do not agree, you must not use our services.
Scope of Services
TrustlyPay provides the following services, either directly or via authorized partners:
- AEPS (Aadhaar Enabled Payment System) – Cash withdrawal, balance enquiry, mini statement, and other Aadhaar-authenticated transactions.
- Micro ATM (mATM) – Card-present transactions, cash withdrawal, and balance enquiry using portable devices.
- UPI & Payment Gateway – Payment acceptance through UPI, debit/credit cards, net banking, QR codes, and payouts.
- Taxation Services – GST registration, GST filing, ITR filing, and other related compliance services.
- Insurance Services – Distribution of life, health, and general insurance products through IRDAI-licensed partners.
Eligibility
- You must be at least 18 years old to use our services.
- For merchant services, you must have a valid GSTIN (if applicable), PAN, and bank account.
- You must comply with all applicable laws, including RBI, NPCI, UIDAI, IRDAI, GST, and Income Tax regulations.
Registration & KYC
- Certain services require you to register and complete Know Your Customer (KYC) verification.
- You must provide accurate, current, and complete information.
- We may refuse or terminate services if false or misleading information is provided.
AEPS & mATM Usage Rules
- All AEPS and mATM transactions must be initiated only by the account holder, with proper biometric/card authentication.
- Merchants must not perform transactions on behalf of non-consenting customers.
- Any fraudulent transaction will result in immediate suspension and possible legal action.
- AEPS services are available only during UIDAI and bank switch uptime.
UPI & Payment Gateway Usage Rules
- UPI and gateway transactions must comply with NPCI guidelines and RBI directives.
- Chargebacks and disputes will be handled as per network rules.
- High-risk merchants (including restricted industries) must obtain prior written approval from TrustlyPay.
Taxation Services
- TrustlyPay acts as a technology facilitator and may engage registered tax practitioners for service delivery.
- We are not responsible for penalties arising from delayed or inaccurate filings caused by incorrect or incomplete information provided by you.
Insurance Services
- Insurance products are provided through IRDAI-licensed partners.
- TrustlyPay is not the insurer; we act only as a corporate agent/partner distributor.
- Claims settlement is the sole responsibility of the respective insurance company.
Fees & Charges
- Fees are disclosed at the time of onboarding or transaction.
- We reserve the right to revise fees with prior notice.
- Taxes (GST, etc.) will be applicable as per law.
Settlement & Payouts
- Settlement timelines (T+0, T+1, or otherwise) are as per the agreed commercials.
- Delays may occur due to bank holidays, technical issues, or compliance reviews.
Prohibited Activities
You may not use our services for:
- Money laundering, terrorism financing, or illegal activities.
- Transactions violating RBI/NPCI/UIDAI/IRDAI norms.
- Processing payments for restricted goods/services without approval.
Data Privacy & Security
- We process your data in accordance with our Privacy Policy.
- Sensitive data is encrypted and transmitted securely.
- You are responsible for maintaining the confidentiality of your login credentials.
Limitation of Liability
- Services are provided on an “as is” basis; we make no warranties regarding uptime or accuracy.
- We are not liable for indirect, incidental, or consequential damages.
- Our total liability shall not exceed the total fees paid by you in the last 3 months preceding the claim.
Indemnification
You agree to indemnify and hold TrustlyPay harmless from any claims, damages, or expenses arising from:
- Your breach of these Terms.
- Your misuse of the services.
Suspension & Termination
- We may suspend or terminate services without notice in cases of suspected fraud, regulatory non-compliance, or breach of Terms.
- You may terminate by giving 30 days’ written notice, subject to settlement of all dues.
Governing Law & Dispute Resolution
- These Terms are governed by the laws of India.
- Any disputes shall be subject to the exclusive jurisdiction of the courts of respective city and state.
Amendments
- We may modify these Terms at any time. Updated versions will be posted on our website with the effective date.
- Continued use of services after changes constitutes acceptance of the updated Terms.
