All products and/or services relating to the games (hereinafter collectively referred to as "Services") offered to You (hereinafter referred to as "You", "Your", "User" or "Player") and offered by Rummy. and/or its affiliates, subsidiaries, associates and partners (hereinafter referred to as "We" or "Us" or "Our" or "Company") through its mobile application, namely, Rummy (hereinafter referred to as the "Application") are subject to the Terms of Use and Service (hereinafter referred to as "Terms") as specified herein.

These Terms, as updated or modified from time to time, constitute an agreement between You and Company and shall govern the relationship between You and Company with respect to Services. You must read, understand and agree to, and be bound by, the Terms for accessing the Services. You must not access the Application or Services, in any manner, in case You do not expressly accept these Terms in its entirety.

1. AGREEMENT

1.1. These Terms along with privacy policy (hereinafter "Privacy Policy") and the rules of the game-play, that is, Game Rules (as defined hereinafter) as may be notified and updated from time to time by the Company, constitutes a binding agreement between You and Company. You must read, understand and accept all the provisions envisaged under these Terms, Privacy Policy and Game Rule before accessing the Services and/or the Application in any manner. You understand and agree that Company reserves the right to modify or update these Terms, Privacy Policy and Game Rules at any time without needing to serve a prior notice upon You. Any such modification or update in the Terms, Privacy Policy and Game Rules shall, however, be intimated to You under the Notice tab within the Application. You must accept the Terms, Privacy Policy and Game Rules so modified or updated to continue accessing the Services and Application. In case You do not accept the Terms, Privacy Policy and Game Rules so modified or updated, You must cease to access the Services and Application forthwith, and shall terminate Your membership (as referred to hereinafter) and inform Company immediately. If case You continue to access Services and Application after any such modification or update to these Terms, Privacy Policy and/or Game Rules, it shall be assumed that You have agreed to such modification or update, and be bound by the same.

2. MEMBERSHIP

2.1. Your application towards registration as a member and a registered user of the Services shall be deemed as You having expressly agreed to these Terms, Privacy policy and Game Rules, as updated from time to time, and therefore, shall be bound by the same at all times. Your registration as a member and registered user of Services shall be subject to discretion of the Company, and the Company shall reserve the right to terminate Your registration/membership by serving an instant notice based on subjective judgement and reasons.

2.2. Without prejudice to the foregoing, the membership and access to Services shall be allowed to any person above the age of 18 years, and the registration for membership shall be guided by the registration process stated in the Application. The Company reserves the right to verify the age of You as a user of Services by requesting for specified documentary proof in this behalf, and shall also reserve the right to impose ban in the event any documentary proof is found to be false.

2.3. Notwithstanding, any person requesting registration/membership shall, at all times, be bound by the applicable laws in the jurisdiction in which such person is situated. The Company shall be not be liable, in any manner, towards violation of any such applicable laws by the person requesting registration/membership. Neither Company, nor any other third-party providing any content on the Application, nor their related agents shall be responsible and liable for any direct or indirect, incidental or consequential injuries or damages that can arise as a result of the use of, or inability to use, Our Application by any person who is below the age of 18 years.

2.4. You acknowledge and agree that We are not obligated to cross-check or verify any of Your information and hence We do not take any responsibility for any consequences or outcomes that may result from Your providing false, incorrect, incomplete, concealed or irrelevant information to Us. Therefore, You are required to provide Us with complete and authentic information to the best of Your knowledge to play Our Games. Also, You should not be a politically exposed person or convicted of any crimes. You should not be on the UN sanction list/ work for UN sanction list.

3. GAME VARIATIONS

3.1. The Company may offer various tournaments, promotional games, practice games, cash games and other non-cash games on its Applications (hereinafter collectively referred as "Games"). Each of such Games shall be governed by specified set of rules of game-play notified by the Company (hereinafter referred to as "Game Rules"). The Game Rules can be found in the Help section in the Application. You are required to play any of such Games solely in accordance with such notified Game Rules.

3.2. The Company offers the Games in two categories:

i. Cash Game(s) are such Games that require participants to contribute make certain payments and/or to maintain a certain minimum cash balance in their account to participate.

ii. Non-cash Game(s) are such Games that does not require participants to contribute or make any payments or to maintain a certain minimum cash balance in their account to participate, that is to say, such Games are completely free to be played.

4. ACCOUNT CREATION AND OPERATIONS

4.1. You must register Yourself through the Application before accessing Services or playing the Game(s). The registration can be done by clicking on the "Register" section in the Application, and the registration can be proceeded with in accordance with the steps directed therein. In order to register Yourself, You must create Your unique login name and password after submission of certain information as may be required therein. Further, You may be asked to submit certain documents for verification of Your age and authenticity of other details as part of KYC (Know Your Client) process. Failure to furnish any such information or documents, or in case any information or document submitted by You is found to be false, Your registration along with Your account associated with such registration may be suspended or terminated by Us, at Our discretion, without any prior notice. We shall not be liable towards, or be obligated towards, in any manner, for any loss incurred owing to account so suspended or terminated.

4.2. You acknowledge and agree that completing KYC process as required by the Company shall be a pre-condition to complete registration process on Our Application. Further, You agree that the Company may require You to re-verify Your credentials by completing the KYC process on periodical basis.

4.3. You must register Yourself only once with correct credentials, and shall not make more than one account on the Application, that is to say, You shall access the Services or play the Games only through one account. You are also prohibited from using account of someone else to access the Service or play the Games. In the event, You are found to be accessing the Services or playing the Game(s) through someone elses account, You may barred by Us, for present and future, from accessing the Services or playing the Game(s), and also, We may, at Our discretion, terminate all the accounts associated with You or such other person without any prior notice. Further, You shall solely be responsible for any damage or loss incurred to any such third-person whose account may be used to access the Services and play the Games(s).

4.4.By registering Yourself and by accessing the Services, You hereby agree to not sharing or distributing Your password and/or other account information to any third-person, that is to say, only You shall be authorized to access Your account and the Services. We shall not be responsible towards any loss or damage that may occur owing to such sharing of password and other account information. You shall solely be responsible towards all the activities on the Application through Your Account. You understand and agree that We shall not incur any liability for information provided by You to anyone which may result in Your account on the Application being exposed or misused by any other person or any other harm or loss being suffered by You.

4.5.You undertake not to impersonate another person or user of Our Application, or attempt to get a password or any other account information not belonging to You for accessing Our Application. We may initiate appropriate legal proceedings against You as well as notifying the relevant regulatory or law enforcement authorities where appropriate, apart from suspending or terminating Your privileges for the use of the Application, in the event, We have reasonable grounds to believe that You have violated Your undertaking herein in any manner. Any act in violation of this clause by You shall be deemed to be a material violation by Us.

5. ACCOUNT BALANCE AND REFUNDS

Any real money in your account is your actual account balance (Account Balance). Any winnings would be added and/or losses incurred from using the services, entry or other fees, previously withdrawn money by the user or amount forfeited by us for any suspected fraud or rejection or cancellation of transaction(s) by your or any third party bank, resulting of charge-backs, insufficient funds or any other reason would subsequently be subtracted.

In order to participate in Paid Games, you are required to maintain a Account Balance in your Account. In relation to such Account Balance, you undertake/ understand the following:

All credits to your Account Balance ("Account Credits") must be through PGs, in furtherance to Section 3.1 above, the Company is not responsible for authorization/denial of any such transactions, and such transactions are subject to and must be undertaken in accordance with the terms and conditions specified by such third-party payment gateways.

All Account Credits must be through instruments/accounts which belong to you and are in your name.

Any winnings in Paid Games will be credited exclusively to the Account Balance. Any withdrawal of amounts from your Account Balance ("Account Withdrawal") may be carried out only in accordance with the terms of this Agreement.

The Company may impose daily/per-session limits, or other types of limits, upon your ability to perform Account Credits or Account Withdrawals, in order to encourage responsible play as well as to prevent unauthorized or illegal activity. You will be informed of such limits at the time when they are imposed, and will also be informed of any change to such limits.

Account Withdrawals can be requested by you at any time, subject to any limits which have been imposed, and will be accepted when catered to deposit method restrictions, bonus restrictions and/or security reviews. You can withdraw amounts only within your transaction limits and levying any processing fees for withdrawal methods that we notify you of before cashing out. Account Credits and Account Withdrawals are subject to any charges/fees levied or charged by banks, payment gateways, processors, or other financial institutions or intermediaries.

The user account will be checked for any games played or reward claims and the request will be processed within 2 weeks. The rewards for any reward claims will be deducted and the balance refunded in the bank account used for the original transaction. A request for cancellation of any transaction would be processed within 2 weeks given the player has the balance of the transaction in his/her account. Please note that any Account Withdrawal will be effected by the Company only in favour of an Indian Rupee account in your name.

The Account Balance is not transferable or negotiable, except to the extent as may be expressly permitted by the Agreement. Further, no Account Withdrawal will be allowed from the Account Balance associated with an Account, unless the relevant User has played sufficient number of Paid Games (which may be determined solely by the Company in its discretion) subsequent to the last recorded Account Credit.

A cash amount corresponding to the aggregate of Account Balances of all Users is maintained in unencumbered bank account(s) by the Company at all times, separate from other funds of the Company. Such Account Balances are available to be withdrawn at any time by users, subject to specific restrictions contained in the Agreement. To the extent permitted by law, the claims of users over amounts corresponding to their Account Balances will be given preference over all other claims.

Any amount from your winnings may be reported and withheld complying to any applicable law. It is solely your responsibility to deal with all the taxes involved with your winnings. Neither prize money nor balance can be redeemed for any other prize nor can it be transferred. Although payment processing will be made as soon as possible, due to our security reviews, payments may be delayed and withheld with us.

Certain additional charges may be levied upon you by the Company (including applicable withholding taxes), or by payment gateways, banks or other intermediaries, at the time of purchase of Account Credits and Account Withdrawals. You agree to pay any such additional charges, which may vary between various banks, payment processors or other intermediaries.
